Terms of Service

These Terms of Service (“Terms”) govern your use of and access to the websites at www.str-growth.com and www.chasinghomestays.com and any products or services offered on these sites (collectively, the “Services”) provided by Archway Ventures LLC, doing business as Chasing Homestays (“Archway,” “CHM,” “we,” “our,” or “us”).

By accessing or using our Services, you acknowledge and agree to:

  1. Be bound by these Terms; and

  2. Our collection, use, and disclosure of information you provide in accordance with our Privacy Policy (incorporated herein).

PLEASE READ THESE TERMS CAREFULLY. These Terms include a waiver of your right to participate in a class or representative action and require disputes to be resolved by binding arbitration, except as otherwise provided in the Dispute Resolution section below.

If you do not wish to be bound by these Terms, do not access or use our Services.

1. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we’ll provide notice (e.g., by email, a notice on our websites, or updating the “Effective Date” above). Unless stated otherwise, changes take effect immediately upon posting. Your continued use of the Services constitutes acceptance of the updated Terms.

2. Use of Information & Intellectual Property

Unless otherwise stated, all content on our Services is owned by Archway/CHM or our licensors. You may view, download, and print content for personal, non-commercial use only, provided you keep all copyright and proprietary notices intact.

You may not:

  • Copy, distribute, modify, display, or create derivative works without our written consent.

  • Use our trademarks, logos, or service marks without permission.

  • Use our Services or content for any commercial purpose not expressly permitted.

3. Trademarks

“Archway Ventures,” “Chasing Homestays,” and related names, logos, and slogans are trademarks of Archway Ventures LLC. All other trademarks are the property of their respective owners.

4. Consent to Monitoring and Disclosure

We may monitor use of our Services to comply with laws, protect our operations, or enforce these Terms. Any information or materials you send us (including ideas, feedback, or suggestions) are considered non-confidential, and we may use them without restriction or compensation to you.

5. User Content

By posting, uploading, or submitting content (reviews, photos, comments, etc.) to our Services (“User Content”), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, distribute, and display such content.

You represent and warrant that:

  • You own or have permission to use your User Content.

  • Your User Content does not infringe on others’ rights or violate laws.

  • Your User Content is not defamatory, obscene, threatening, harassing, or otherwise unlawful.

We reserve the right to remove any User Content at our discretion.

6. Prohibited Uses

You agree not to use the Services to:

  • Access unauthorized areas or systems.

  • Impersonate others or misrepresent your affiliation.

  • Violate laws or promote illegal activities.

  • Interfere with or disrupt our Services.

  • Harvest personal information without consent.

  • Post harmful or malicious code.

You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use our Services.

8. Disclaimer of Warranties

Our Services are provided “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, Archway/CHM shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from your use of our Services.

10. Third-Party Links

Our Services may link to third-party sites. We are not responsible for their content, policies, or practices.

11. Security

You agree to follow any security protocols we provide and not to attempt unauthorized access to our systems.

12. Termination

We may suspend or terminate your access to the Services at any time for violations of these Terms or other lawful reasons.

13. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules.

Arbitration Agreement:

  • You and Archway/CHM agree to resolve disputes by binding arbitration through JAMS under its Streamlined Arbitration Rules.

  • No class actions or representative proceedings are permitted.

  • You may opt out within 30 days of first agreeing to these Terms by emailing legal@archwayventures.com.

14. Notices

By using our Services, you consent to receive notices electronically. You may withdraw consent by emailing legal@archwayventures.com, but doing so will terminate your access to the Services.

15. General Provisions

  • These Terms are the entire agreement between you and Archway/CHM.

  • If any provision is found invalid, the remaining provisions remain in effect.

  • We may assign these Terms; you may not assign them without our written consent.
